so is the ball dead or live? does the runner returning to 1st base get second or third?  

Answer
The ball continues to be live.  Runner is not awarded any bases. It's just a bad throw that happens to hit the runner on the foot.  As long as the throw by the shortstop or the hitting of the foot by the runner weren't intentional, and the ball stays in bounds, then you just have a live ball running around the field.  

If the ball does go out of bounds, the runner is award 2 bases from the base he last achieved.  Therefore, he would be awarded 3rd base.
