flying with firearm

Question
I will be flying US Air and want to take a firearm, it will be in the checked baggage. the best I read it is alright to carry firearms "parts" without declaring them. If I take the gun apart, place the pieces in two separate boxes, would this be legal?

Answer
No, or at least, you may have to have your attorney argue it to a jury. There are such a myriad of laws that it is hard to know which one to apply. The receiver or frame of the gun will not be "parts," but will be considered the gun itself. If it is being transported with other parts, they may/will suspect that you intended to get it past the baggage check for it to be assembled later on-board.

Your best course of action would be to declare it. They will have you fill out paperwork including an affidavit that it is unloaded, will tag it and put the tag inside your luggage (they no longer mark baggage from the outside as containing firearms).

Doing it any other way may get you into a world of trouble.
