Liability

Question
Hi Pat,

I'm an online retailer for skates both inline and quad.  I was wondering what you thought my liability was in selling these products?  I think most rinks carry liability insurance but that's when people are actually skating.  Could I be sued for providing a product that allows someone to injure themselves?  What do you think?

Have a look at my product line and let me know if this is something you've heard of being an issue.

Answer
Hi John,
I suppose this is something you should look into before starting up a business but no......I do not believe there is a liability issue involved in selling the item, unless you've sold a faulty product knowingly.  Faulty product issues should go back to the manufacturer.

The liability comes into play if they are skating at a rink and there was neglect on the rinks part such as things on the floor that people could trip over etc.

I would still check with an attorney to see just where your liability lies.

You asked if you could be sued for selling a product that allows someone to injure themselves?   If that were the case then a lot of companies would be out of business and would be in court all the time.

Enjoy your new business, make sure you have worthy products but also double check with an attorney to see exactly what you may be liable for.

  Take care and good luck
Pat
